Truck Magnet LLC ("Truck Magnet," "we," "us," or "our") respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, share, and protect your information when you use the Truck Magnet mobile application and our website at truckmagnet.com (together, the "Services"), and describes your privacy rights and how the law protects you. By using the Services, you agree to the practices described here.

2. Information We Collect

We may collect, use, store, and transfer the following kinds of personal data:

• Identity Data — first name, last name, username, or similar identifier.
• Contact Data — email address and mobile phone number.
• Account & Profile Data — username and password, preferences, feedback, and survey responses.
• Location Data — location information you provide when creating or searching for shipping/receiving locations, and, if you grant permission, your device's location while you are actively using the app's map features (see Section 5).
• Usage Data — information about how you use the Services.
• Technical Data — IP address, device and browser type, operating system, time zone, and similar diagnostic information.

3. How We Use Your Information

• Register you as a user and manage your account.
• Verify your identity and secure your account, including sending one-time verification codes (OTP) by text message or voice.
• Provide, operate, and improve the Services, including creating, sharing, and accessing location information.
• Send you account-related and operational notifications, such as load and shipment status updates.
• Communicate with you about the Services and respond to your requests.
• Maintain the security and integrity of our platform.
• Comply with our legal obligations.

4. Text Messaging (SMS) Program

With your consent, we send text messages to the mobile number associated with your account. These fall into two categories:

• Verification codes (OTP) — one-time passcodes used to verify your identity and log you in.
• Account & load notifications — operational alerts such as shipment and load status updates and account notices.

You provide consent to receive these messages when you enter your mobile number and create or verify your account within the app. Message frequency varies based on your account activity. Message and data rates may apply. You can opt out of text messages at any time by replying STOP; reply HELP for assistance. Carriers are not liable for delayed or undelivered messages.

5. Location Data

Location is central to Truck Magnet, which helps drivers find shipper and receiver locations and related delivery information. We collect location data in two ways:

• Location you enter — addresses and place details you add when creating or searching for locations.
• Device location — if you grant permission, we access your device's precise location while you are actively using the app (in the foreground) to show your position on the map, provide directions, and surface nearby locations. We do not collect your location in the background, and you can disable location access at any time in your device settings.

We use location data only to provide the map and navigation features of the Services. We do not sell your location data.

6. How We Share Your Information

We do not sell your personal data. We may share personal data only in the following circumstances:

• Service providers who process data on our behalf under contract and only to operate the Services — for example, Twilio (SMS and identity verification), cloud hosting, and analytics providers.
• Analytics providers that help us understand and improve the Services.
• Legal and safety — with law enforcement or other parties when required by law or to protect our rights, users, or the public.
• Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.

When you create public location entries, the information you provide (excluding personal contact details unless you choose to include them) may be visible to other users of the platform. Your phone number is never made public.

7. Data Retention

We retain your personal data for as long as your account is active and as needed to provide the Services. After you delete your account, we delete or de-identify your personal data within a reasonable period, except where we are required to retain certain information to comply with legal, tax, accounting, or security obligations, or to resolve disputes and enforce our agreements.

8. Your Rights

Depending on where you live, you may have the right to:

• Access the personal data we hold about you.
• Request correction of inaccurate data.
• Request erasure of your personal data.
• Object to, or request restriction of, our processing of your data.
• Request transfer of your data (portability).
• Withdraw consent at any time where processing is based on consent.

If you are a California resident, you may have additional rights under the CCPA/CPRA, including the right to know, delete, and opt out of the "sale" or "sharing" of personal information; we do not sell or share personal information as those terms are defined by California law.

9. How to Delete Your Account and Data

You can request deletion of your account and associated personal data in any of the following ways:

• In the app — go to Settings → Account → Delete Account and confirm.
• On the website — sign in at truckmagnet.com/settings and choose Delete Account in the Danger Zone section.
• By email — send a deletion request to privacy@truckmagnet.com from the email address on your account.

When you delete your account, we remove or de-identify your personal data as described in Section 7. Some information may be retained where required by law or for legitimate business purposes such as fraud prevention.

10. Children's Privacy

Truck Magnet is intended for professional drivers and other adults and is not directed to children under 13 (or the minimum age required in your jurisdiction). We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us and we will delete it.

11. Data Security

We implement appropriate technical and organizational measures to protect your personal data from accidental loss and unauthorized access, use, or disclosure. We limit access to your personal data to employees and service providers who have a business need to know. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Cookies and Tracking

We use cookies and similar technologies on our website to operate the site, remember your preferences, and understand usage. You can set your browser to refuse cookies or to alert you when cookies are being sent; some features of the site may not function properly without them.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and revise the "Last updated" date above. Material changes may also be communicated to you within the Services.
